As many people are aware, there is an ongoing crisis of sexual abuse within religious organizations of many faiths. The Catholic Church has been in the news on a regular basis due to these crimes and abuses of power coming to light. When brave victims come forward with the truth about child sex abuse in the church, the credibly accused priests are added to a publicly available list.

California priests who served in a diocese and are accused of sexual misconduct can be sued in a court of law and in some cases face criminal charges for their actions. These predators abuse the trust and faith of their victims by taking advantage of their position in the community. In some cases it seems that the hierarchy of the church protects the abusers, rather than their innocent victims.

Where Do These Lists of Accused Priests Come From?

Survivors who have been sexually assaulted bring the truth to light, and by working together to file lawsuits alleging abuse, these victims not only find closure, but may also be entitled to damages for what they have endured. In addition, these actions make public the names of priests or religious brothers who have sexually abused others in the past.

Some examples of the released lists of priests accused of abuse in California include:

  • In 2018, a clergy abuse survivor worked with attorneys to release a list of more than 300 local priests accused of sexual misconduct, and stated that leaders of the San Francisco Bay Area dioceses were engaging in a cover-up to prevent the information from coming out. Eleven California dioceses were named in the lawsuit, which centered on abuse that happened repeatedly when the victim was only 10 years old.1
  • Also in 2018, in Orange County, advocates and a survivor of priest abuse publicly identified 72 priests accused of sexually abusing minors in the Catholic Diocese of Orange. This was 14 more than the diocese itself had recorded in its own official list. Due to the push for greater transparency, the Archdiocese of Los Angeles added 54 more priests to its own list, for a total of 323 at the time.2
  • In 2019, the Diocese of Sacramento added 44 priests to their list of accused priests. This update was based on staff record reviews going back as far as 1950. The process by which these official diocese lists are updated is very slow. None of the accused was actively ministering at the time. In many cases the statute of limitations may have run out, or the priests may have passed away by the time these review processes are complete.3
  • In 2020, an investigative news site compiled and published a comprehensive list of Catholic priests who have been credibly accused of abuse. Ten dioceses in California have released their own lists, bringing 757 names to light, and the news site ProPublica published the names of the accused priests. They also highlighted the 5 California dioceses that had not released their own lists at that time.4

What Should You Do If You Think Abuse Is Occurring at Your Church?

If you have good reason to believe that sexual abuse is occurring in any situation, you should notify law enforcement immediately. The situation can be investigated, potential victims can be protected, and your fears can be put to rest. Checking the list of accused priests in your area can be helpful before you choose a local church, or if you have general concerns about the safety of yourself or your children.

It is important to remember that many of the accusations made against priests or clergy on these lists have not been presented in a court of law, and these individuals are innocent until proven guilty. Very often, the victims will reach a settlement with their abuser, which may require that they drop any lawsuits pending and even agree to keep quiet about what happened. In some cases too much time may have passed since the accusation was made for any legal action to be taken.

Should You Take Legal Action If You Have Been Abused by a Priest?

There are many laws in place which protect victims of clergy abuse and may extend or suspend the statute of limitations that protects many of these known abusers. California passed AB218 in January of 2020, which opens a 3-year window for victims whose claims were blocked in the past.

This Administrative Bill:

  • Gives survivors of child sexual abuse until age 40 to file a lawsuit
  • Increases the delayed discovery period to 5 years
  • Allows any survivor of child sexual abuse to file a case no matter how long ago the abuse occurred, as long as they file before December 31, 2022

More than 15 other states have put new laws in place to extend the statute of limitations for all child sexual abuse claims, including “lookback” windows of time during which survivors may file a lawsuit no matter how long ago they were victimized.
